EVIDE is the external evidentiary deposit system for digital evidence, decision records and AI outputs. Access always requires a verified DAPI identity, because every deposit must be attributable to a real, identified and non-repudiable subject.

Platform access: without a verified DAPI identity, EVIDE cannot be used โ€” neither via manual dashboard nor via API.

Why is DAPI mandatory? EVIDE does not register anonymous content. It registers events, decisions and evidentiary deposits linked to verified subjects. FEDIS is the forensic layer of EVIDE. The EVIDE deposit creates a verifiable and portable cryptographic record. FEDIS adds the signed forensic declaration, documented chain of custody, and elements required for evidentiary use in judicial, regulatory or investigative contexts. It is not included automatically.

Important notice on the scope of FEDIS services. The FEDIS certification constitutes a complete forensic-legal document, admissible before courts and authorities in the EU, United States, United Kingdom, Canada, Australia, and other jurisdictions recognizing equivalent digital evidence standards.

Delivery of the forensic certificate does not include and does not imply any subsequent activity, including: consultations or meetings with the client and their legal representatives; appointment as a court-appointed or party-appointed expert (CTP); participation in hearings, testimony, or expert technical operations; supplementary expert reports or technical clarifications.

Any activity beyond the delivery of the certified copy is subject to a separate professional fee, exclusive of VAT, and must be authorized in writing prior to execution. Out-of-pocket expenses (travel, accommodation, transport) are likewise documented and pre-authorized.

Manual deposit

Manual deposit is the basic mode of EVIDE and involves no per-intake cost beyond DAPI access. Any user with a verified DAPI identity can deposit files, texts, URLs and structured records directly from their dashboard.

Physical files are automatically deleted from the server at the end of the retention period. SHA-256 hashes and evidentiary metadata remain permanently in the registry and are never deleted.

The API is not mandatory. A lawyer, DPO or consultant depositing evidence individually needs no technical integration. The dashboard is sufficient to create deposits, request FEDIS and manage their files. The API is designed for systems that produce decisions automatically at scale โ€” where volume makes manual deposit impractical.

How does the API work? The endpoint accepts JSON payloads conforming to the current EVIDE schema. Each intake receives a unique evide_id, a verifiable intake_hash SHA-256 and a UTC timestamp. The downloadable payload retains the same hash recorded at intake time.

Important: the API service does not replace DAPI โ€” it presupposes it. The fedis_requested: true field does not automatically generate a forensic certification: it places the record in a queue for separate evaluation and quote.

API records are never deleted
Uploaded physical files are subject to the retention periods shown above. Evidentiary records โ€” SHA-256 hash, UTC timestamp, evide_id, evidentiary profile โ€” remain permanently in the EVIDE registry regardless of plan expiration, file deletion or account closure. This is the architectural value of the deposit: the anchor does not expire.

Permanence is guaranteed by the neutral external deposit architecture operated by Informatica in Azienda: the registry is not hosted on the same infrastructure as the system that produced the record, and its integrity is independently verifiable via standard SHA-256 hashing, without depending on platform availability.
EVIDE is not storage. It is an external evidentiary deposit. The value of the system lies not in simply saving data, but in the ability to transform an event, a record or a decision into a verifiable, attributable and defensible reference over time.

Service Conditions

1. Purpose and Scope
These conditions govern the use of the EVIDE platform operated by Informatica in Azienda, directed by Dott. Emanuel Celano. Access to or use of the platform implies full acceptance of these conditions.
2. Service Availability
EVIDE is provided as-is. We strive for maximum availability but do not guarantee uninterrupted service. Temporary interruptions may occur due to maintenance, technical issues, or circumstances beyond our control. Service interruptions do not invalidate evidentiary records already created: intake hashes and UTC timestamps computed at deposit time retain their evidentiary value independently of platform availability.
3. Force Majeure and Third-Party Dependencies
EVIDE depends on third-party infrastructure including hosting providers, SSL authorities, email delivery services, and qualified timestamp providers. We cannot be held liable for service degradations caused by maintenance, updates, or failures of these providers. In such cases, service will be restored as quickly as technically possible, except where mandatory law requires otherwise.
4. Volume Limits and Infrastructure Compatibility
EVIDE is a shared-infrastructure platform designed for professional use at the volumes indicated in each plan. Users requiring more than 500 intakes/month must contact us before activating such volumes to arrange a dedicated infrastructure solution. Standard service plans are not designed to guarantee enterprise-level SLAs at high-volume or continuous-throughput workloads. Performance degradations caused by volumes exceeding the plan threshold do not constitute breach of contract. We reserve the right to suspend accounts generating disproportionate load without prior agreement, with 24 hours notice and proportional refund of the unused period, except where mandatory law requires otherwise.
5. Price Changes
We reserve the right to modify service prices at any time. Price changes will be communicated with at least 30 days notice via email to the registered address. Users with active paid plans retain their current price until the end of the paid period. Renewal after the effective date of the new pricing will be at the updated rates. Continued use of the service after the effective date constitutes acceptance of the new pricing.
6. Service Modifications
We reserve the right to modify, improve, or discontinue features of the platform with 30 days notice. In case of discontinuation of the platform, intake hashes and timestamps already computed remain independently verifiable through standard SHA-256 verification tools.
7. User Responsibilities
The user is solely responsible for the content deposited. It is prohibited to use the platform to deposit illegal, fraudulent, or rights-infringing content. EVIDE does not moderate deposited content but reserves the right to suspend accounts in case of documented violations.
8. Evidentiary Value and Jurisdictional Responsibility
EVIDE produces independently verifiable evidentiary records anchored to a SHA-256 cryptographic intake hash, a server-generated UTC timestamp, and a verified and attributable identity reference. Combined with FEDIS forensic certification, these records comply with ISO/IEC 27037:2012 international standards, eIDAS (EU Regulation 910/2014), and Federal Rules of Evidence 901-902 (USA), providing structured forensic documentation usable in judicial, regulatory, and investigative contexts across the EU, United States, United Kingdom, Canada, Australia, and equivalent jurisdictions.

The essential distinction: EVIDE and FEDIS operate as a probatory crystallization layer -- not as a guarantee of automatic admissibility. They do not replace the evaluation of the competent authority, the procedural rules of the jurisdiction, or the role of the court. Their function is to reduce uncertainty by documenting the technical conditions that support evidentiary reliability, making integrity verification objective and independent of trust in the certifying platform.

Admissibility, legal weight, or procedural acceptance of evidentiary records may still vary depending on jurisdiction, court, or regulator. The user is responsible for assessing the legal context of their specific proceeding, before subscribing to the service, and for obtaining independent legal advice where required. 9. No Warranty on User-Declared Data
EVIDE verifies structural integrity, identity attribution, and intake timing of deposited records. It does not independently verify the factual accuracy, authenticity, completeness, or truthfulness of user-submitted content, declarations, metadata, or any fields declared by the user unless explicitly stated in the service description. The evidentiary value of an EVIDE record derives from its anchoring and integrity properties, not from any guarantee of the accuracy of the declared content.
10. UTC Temporal Reference
All timestamps generated by EVIDE are expressed in Coordinated Universal Time (UTC) and represent the platform's independently generated intake time at the moment of deposit processing. EVIDE timestamps are generated server-side and are independent of the user's local clock, device timezone, or client-side time references. They do not represent the time of content creation, signing, or transmission by the user. Discrepancies between user-side timestamps and EVIDE intake timestamps do not constitute a platform error.
11. Account Security and API Key Responsibility
Users are responsible for maintaining the confidentiality of API keys, credentials, access tokens, and DAPI codes associated with their account. Actions performed through authenticated credentials -- including API calls, MCP-mediated deposits, and agent-initiated intakes -- are considered attributable to the account holder unless proven otherwise under applicable law. In case of suspected compromise of credentials, the user must notify us immediately at info@informaticainazienda.it. Informatica in Azienda cannot be held liable for deposits, records, or actions performed through credentials that the user failed to protect.
12. Export Controls and Prohibited Use
The platform may not be used in violation of applicable export controls, sanctions regulations, or laws governing digital evidence and restricted technologies. Use of EVIDE is prohibited where such use would violate the laws of the user's jurisdiction or applicable international regulations. Informatica in Azienda reserves the right to restrict access to users or organizations subject to applicable sanctions or operating in jurisdictions where the service cannot be legally provided.
13. Data Retention Policy
EVIDE retains evidentiary metadata, intake hashes, UTC timestamps, authority attribution records, and integrity logs for operational, forensic, security, and compliance purposes. These records may be retained even after account closure, plan expiration, or user-initiated deletion requests, unless prohibited by applicable law. User-uploaded file content is subject to the retention periods specified in the service plan. Intake hashes and evidentiary profiles are not deleted upon file deletion and constitute the permanent evidentiary anchor of the deposit. Users are solely responsible for retaining their own copies of deposited content.

Intake hashes, UTC timestamps, evide_ids and evidentiary profiles constitute cryptographic objects required for the legal enforceability of the deposit and do not fall within the scope of the right to erasure under Art. 17 GDPR, as their processing is grounded in an overriding legal basis: the necessity to comply with legal obligations and to establish, exercise or defend legal claims (Art. 17(3)(b) and (e) GDPR). Personal data in user profiles โ€” name, email, access credentials โ€” remain subject to standard GDPR protections, including the right to erasure, within the limits of applicable law.
14. Limitation of Liability
Informatica in Azienda cannot be held liable for: indirect or consequential damages; loss of data caused by user actions; incorrect interpretations of evidentiary records by third parties; decisions made on the basis of EVIDE records by courts, regulators, or other parties; failure of evidentiary records to be admitted in any legal or administrative proceeding.
15. Jurisdiction
Any dispute shall be subject to the exclusive jurisdiction of the Court of Bologna, Italy, unless mandatory law requires otherwise.
16. Acceptance
Use of the platform constitutes full acceptance of these conditions. Conditions may be updated with 30 days notice via email. Continued use after the effective date constitutes acceptance of the updated conditions.
